WE don't want to continue with this realtor. So, should we have that in the contract that after May.... nul and void?
They have to sell theirs first..

When a listing agreement expires but an offer has been entertained the agent is entitled their listing brokerage portion. Their job was to solicit offers through the listing period and even if in the final days they finally get you an offer then they are protected. Many agents will try to prove the eventual buyer was a result of their efforts after a listing expires but before a new agent lists the home. When this occurs they often can seek their commission often with success. Don't wait out an expiration date of the listing to take a current buyer or you might become part of such an ugly event. I always recommend sellers list for no more than 45 days with the assurance that they will extend the listing if served properly during the first 45 day test period. No seller should be trapped into a long listing with escape fees when they find out their agent is inept. Some market areas have longer market times and there are slow seasons. That is never a excuse however for poor service.

you should be able to list that in the contract under the "addendum" section.

However, I would suggest just holding off signing a contract with the new buyer until after the Realtors contract ends...that way there is no confusion about whether or not the realtor's commission should be paid for the sale.

if you trust the new buyer just make a verbal agreement with them and that eliminates any confusion

You can write in a date limiting the broker..however if he shows the house during the contract and you sell it yourself to that party after the contract...you still owe the commission...is that what you are asking?
