According to the US Constitution, Treason is when one plots to over throw the U.S. Government during a time of war. Last night Tom Morello on the Tavis Smiley Show advocated the overthrow of the American Government which he equated with Nazi Germany & said our president should be hung. Both acts are considered acts of treason under the U. S. Constitution during war times. This puts him in that same category as Al Quida & Hamas. According to the U.S. Constitution, Tom Morello should be killed for treason against America.

Based on your stated facts, I would be disappointed yet not surprised if he were not charged. The trash talk has to stop and the speakers need to start being held accountable.

I don't know who Tom Morello is and never heard of the Tavis Smiley Show but I will answer your question anyway. I would say it depends on the context of his speech. If he was voicing an opinion, it would be freedom of speech. If he was talking of a specific plot, it would be treason. However, the constitution also says that, under certain circumstances, it is every citizens right and duty to overthrow the government and establish a new one.

Yeah, it's not treason, as it is not a plot, it's an opinion. Free speech, my friend.
