If you are a tipped employee, you remployer can legally pay below minimum wage, but your tips have to make up the difference and equal a minimum hourley wage. If tips dont tip the scale your employer has to pay the difference so your paycheck reflects the minimum wage status. You didn't say what you do for a living. Waiters and waitress make below minimum and make it up in TIPS. There is nothing illegal about this. Are you getting paid on or off the books? If your on the books and the type of work is not exempt from the minimum law then you can report him and you can do it anonymously..

If you are under a certain age, then he is allowed to pay them Under Minimum wage. I know for a fact in Illinois they can and I believe you have to be under 16. Under 16, the employer is allowed to pay them 85% of minimum wage.

You can report him to the Federal Wage and Hour Division and they will check into his situation and can make him pay (I believe) if he is paying below the federal minimum wage act. I know they can make employers pay if they have underpaid for overtime for employees.

Yes, and he needs to be reported.
There may be circumstances such as - do you wait on tables? If so, then he is permitted by law, seeing that you will make it up in tips.
If not, and there are no similar circumstances, he needs to be reported. Minimum wage is not to live on.
Contact your Better Business Bureau.

First, find out if he is breaking the law. Some workers, such as waiters and others who get part of their income from tips, are exempt from minimum wage laws.

Ok, then why did you go to work for him if it bothers you so much?? remember that if he goes out of business because of problems you call about, those people working there and you're crybaby self will be in the unemployment line, and hopefully they will find out it was you and thank you for it, real good!
