It is illegal.

Marijuana is a controlled substance and the use or possession of it, without a doctor's prescription, is illegal and that is enough to let the county revoke your husband's parole.

Here is another problem. Most parole officers want their subjects to undergo periodic testing and if he fails a test then he goes back into jail. If they suspect long term use or use in the last few months they can take a hair sample and test that. There will be traces of THC inside of his hair and again that will send him back to jail.

On one hand, it would seem that it wouldn't be a violation of probation because it wouldn't be an offense,

but

on the other hand, the license may be revoked automatically for those on probation.

Give your PO a call. He can tell you the real deal.

Does your probation say no illegal drugs?

By California law, you should be fine. By federal law, they'll probably come and lock you away.

Be careful, don't let the narcs get you down.

I'm no lawyer but, as long as you don't get caught there is nothing wrong with smoking Marijuana.

Marijuana, LEGALISE IT.
