the manager can't answer me is there any legall right to this i've been workin there 5 years they gave me the job and the promotion i never asked for it and been replaced with his best mate

If they have issued you with a new Statement of Particulars and have evidence that this 'promotion' was a permanent arrangement, then your employer would have to give you notice to terminate your current contract and return you to your old one. At this point you can refuse to accept the new contract and claim unfair dismissal with a tribunal. However, there is no guarantee that doing this will get you your old job back (you could just be paid compensation - but end up without a job!)

It's 'Constructive Dismissal' and you can take them to Employment Tribunal (you will have to see a Solicitor).

However it sounds like a small Company and they will have no idea how illegal it is and any claim may take forever....

I ssuggest you do as the others have suggested = get another job as soon as possible and then walk out (you don;t have to give notice, you have already been dismissed)

If you have time in your new job, by all means start proceedings against the old Company, but don't expect any quick results

You already have your answer - the boss's friend needed a job, hence you became disposable. He doesn't want to give you an answer because the answer is, "I wanted to give your job to my friend."

Unfortunately there is nothing illegal about this. If you were to file a claim, the "official" explanation would be that they needed someone with more experience, you weren't working out, etc.

Your best bet is to become as disposable as the boss seems to feel you are by finding another job altogether. You really don't want to work for someone with those questionable ethics anyway, do you?
