The person to blame is the one that threw the stone. How badly was your daughter hurt? The bus company had no control over this situation. If there was an accident caused by something on the seat or floor that caused injury then it would be the company's fault. Could it be that a rock hit the window at random without a person throwing it, or did you see them? I have had windshields crack from a stone hitting it when I was on a road with no one around but farmland and no houses or people in sight.

How badly was your daughter injured? I hope she is ok. Are you wanting to get compensation to pay for treatment for her or are you just wanting to earn money out of an unfortunate incident? Today's culture of suing the moment anything goes remotely wrong is what is crippling our economy and life style. For example, my niece isn't allowed to be taken to the park with her play group because if she falls and hurts herself they don't have public liability insurance to cover that so they all have to stay indoors on a beautiful sunny day. I'm sorry, but when did minor accidents and for that matter more serious ones stop being unfortunate terrible events and start becoming someones fault? If your daughter needs the money to recover from this incident then fight the case, but if not just put it down to experience. Let us all try our best to stop this culture before it becomes ingrained.

London Transport are right here, this is a matter for the criminal injuries compensation board. Unless you can prove it was a London Transport employee throwing the stone under company instructions they are not liable. This sounds more like an antisocial little thug type of behaviour, which makes it a criminal matter.

you can get a solicitor but they are pretty much right. They are only responsible for what they could have reasonably protected your daughter from. To know that a person would throw a rock hard enough onto a bus to hurt someone might be unreasonable to expect from them.

The only form that the transport would be liable is if the driver was responsible in any form, by provoking the third party to throw the stone.
If you cant prove this, you don't have a case.

They are right if they did nothing about it. If they didn't investigate or stop this, then yes, they are at fault and you should exercise your rights fully. If not, then see to it that this person who threw a stone at your daughter gets proper penalty by this bus company - either by fine or through court. Best of luck to you, I hope that your daughter's okay. She's so luck to have a father like you.

I think you should have stopped the bus and beat some ***. But at this point I think since there is nothing they could have done to prevent it they are not responsable. What next, you can't have windows on busses? Sorry about your daughter

yeah, get a solicitor, hopefully they will take your money and then advise that you have no case against the bus company, then you need to hire a private detective to find who threw the stone

True, they did not cause the stone to be thrown into the bus. But does that mean they have no responsibility in the matter? I am not sure of the answer to that. I suggest you get a legal opinion.
