I recently asked a question on here in regards to obtaining custody of our son. We live in Ohio and I've been told that it is a "mom" state. After a thorough investigation through the legal system, I have gathered information of her having each of her children with a different father as well as cheating. When we were together, while I was away at work on the grave yard shift, she slept with other men while the kids were asleep, even with my two-year-old son right there. She's also haven an affair with someone else (her best friend's boyfriend) and keeps running off over there with my son without leaving me contact info in case I want to talk to my son or for an emergency. She is betraying her friend about this and we are both hurt and upset. Because of her repeated patterns of infidelity, no money and residence, no job, no driver's license or permit (all of this spanning across almost ten years), and even possible welfare fraud, can this help me in seeking custody of my son? Thank you

EVERTHING depends on how she treats her children. What adults do sexually is adult stuff and doesnt necessarily mean she can be proven an unfit mother. The no money and no residence, and no licence, especially if she is driving her children around could be a reason to show her up as an irresponsible mother, unfit, well that depends on how a judge treats a driving offence and the capablities of the mother to raise her children well. Welfare fraud could send her to jail, in which case her children will need to be in the custody of someone else. If you can prove her children are in danger, and that includes being around immoral behaviour, then yes, you do have a case. I would be ringing a lawyer and finding out just what your rights are.

Just a question....does she have legal custody of your child, or is it just an understanding? If she has nothing to say she has legal custudy, then what is stopping you from taking your son. You are his father, you have equal rights and if you take him, then she is the one who will have to fight for custody...she is the one who will have to prove you are an unfit father and she is a fit mother. If nothing is in writing then what is stopping you from taking your son?

well..tell ya this...I have been married 11 years and just obtained my Driver's license. Reason: afraid to drive so I used Public Transportation...including my husband was very nice about it and we car pooled to work..I got the license for me..so I could overcome the fear..not having a driver's license does not make you loose your children.

Welfare fraud..my husband's ex did that...she was found out, they did nothing except she can never have benefit again.

Althought there are a few things that could help you. The access to emergency contact information and if she refuses to allow you to visit with the child. Her not having a residence and moving in with strange people all the time is one other thing...

Sleeping with people...some states dont care about that...BUT while a child is in the room.. that is a whole different deal..my suggestion is to get a phyc. eval. of the child to see if there is any trauma..ask the court they will order it..

Absolutely, you need to have documentation of all the actual instances where she is being an unfit parent. Adultery may not fall under that category, but the lack of residency, job, money etc may be enough. If you really want to fight dirty, rat her out to the "friend" she's screwing over, she could probably cough up some more dirt. But be sure if you have proof of her infidelities you document them as well. She's not serving as a responsible role model, and that might play a factor as well.

No it can not....can`t you see it`s all about you being mad at her for what she did to you and not about her being an unfit mother. Being unfaithful doenst make you an unfit mother nor frauding welfare. I am putting together all your questions you`ve posted on here and you`re a mad man. Slow down, put aside what`s she`s done to you and do what`s best for your son, cause you never talk about what`s best for your son. The best for him is to have as much as possible both his parents.

Check with your lawyer and see what rights you have and what is considered unfit in your state. I am sure that you would need actual facts to back everything you say that she is doing.

I certainly think it could help you in getting full custody of your son. no child should be exposed to such behavior.

Nope. Sleeping around is not a crime. Drugs and/or alcohol abuse might work, but just because she's sleeping around is not grounds to terminate her parental rights. Sorry.

I wouldn't count on it. The fact that you work the graveyard shift isn't looking good for you.
