my bankruptcy has been discharged. i refianced my mortgage and paid it off early. well my mortgage company found an error and owe me a refund. i never received the refund. the bankrupty courts took it . can they do this after all my creditors had already been paid. it just sounds illegal.

wow what a country...its amazing people can file bankruptcy,have their debts discharged,but still manage to keep there home and refinance to pay it off early...you should be happy you were able to keep your home and not chase after some small amount of money

If the error occurred before you filed your bankruptcy and you failed to exempt it, or had no more exemptions to apply toward it, the trustee owns it and will use it to pay himself and the remainder to the unsecured creditors.

It might have been possible to re-open your case and add the error as an asset and apply any remaining exemptions to it, but either you did all this yourself or you failed to get a good bankruptcy lawyer when you learned of the error.
