My van was badly crushed on the left front hood. A witness who apparently was biased ( the person who crashed into my car and the witness were chatting waiting for the cop to arrive). After the officer arrived (in about 15 minutes) I was asked for my license and registration and was served with red light violation citation ? I am 100% positive that the light was not red when I crossed the intersection. The police officer was not present when the accident happened, he did not ask me my version of as to what had happened ? I was given an unfair citation based on the witness's account who probably sympathized with the guy who hit me ?
What should I do ? Shouldn't the officer ask me my side of the story ? If I was crossing the intersection at yellow, I still had the right of way , the person who hit me was also trying to make the light, was trying to make a left.
Should I get an attorney? I have a clean record.

If this is a local traffic violation, I would take some photos of the intersection and make a diagram showing where you were and where the other guy was when the accident happened. Bring your evidence to the initial hearing. Plead not-guilty. You will likely then go to conference with the city attorney or legal department.
