my husband is not on the birth certificate of this child and was told for 9 years that the boy is not his.
now the mother is claiming maintenance and has told my hubby if he contacts her or her son she will get him done for harrasment?! also the csa say they wont do a dna test cos he forgot to tick the yes or no box on "is there a chance the child is yours" so they take it as a YES!!!

If your H was deceived as to his paternity, mother cannot ask for back support for prior 9 years.
But she can ask for support going forward.

The threat re harassment is bogus. If she is naming him as the father for money then he's the father for visitation. Can't have it half way.

He DOES get a DNA test. CAS cannot make any presumptions outside of a statute, and most presumptions re paternity are based on some AFFIRMATIVE action (like holding the child out as your own, name on birth certificate, etc.).

He needs to pay for a private DNA test. He needs to take her to court and the judge can make her submit the child for DNA testing. This can most likely be turned into the CSA office.
