If someone suffering from clinicl retardation there will probably be no trial at all for that person. It's pretty much a waste of time and money at the expense of tax payers. Besides, in order to stand trail a person must be in their right mind. The person in question is not eligable for trial. If he prson is a threat to himself or others he'll be placed in an institution for treatment and observation. Your question is silly and in very bad taste.

They would not be tried like everyone else. They might be sent to a state mental hospital if they are found to be violent. They can't just be left out in public.
