A teacher has the right to take any distraction away from a student. A cellphone is no exception. The teacher though should give the student a few options like having a parent come into school to get the phone, or waiting a set time period. Since it is a cellphone, and you truly might need his, I would speak with an administrator on getting it back after school. I would also try to apologize to the teacher, and ask him to get it back after school before going above his head.

They have every right to confiscate the device if you were willingly breaking school policy.

The reason why cell phones are not allowed in school is because they are a distraction/ Student will constantly text, and check them during class time creating a difficult learning environment.

Most schools do not have an issue with you having the cell phone, if it is kept out of sight and silent. There was not reason you should have been checking it in class.

You must have been playing with your phone while in school, which the teacher has every right to take away from you. I do think he should have given it back at the end of class/school though.
