He is incarcerated, and can't fight it with a lawyer, but won't sign it, is there a time limit in which he has to reply or sign it? Can I get divorced?

He can be served by publication. Yes you can get a divorce. To make sure it is done correctly I would hire an attorney instead of depending on forms you downloaded from the internet. Good luck.

You should check to see if you can report him missing. I know at one time you could report a spouse missing in a newspaper ad and if no reply in 90 days, you could force the court to grant you a divorce. Times have changed, and this law may have too! But it's worth checking into anyway!

You can still divorce him, but it will take longer. File the pepers and let the courts handle it. Eventully it will be granted even if he is against it.

where I live you can divorce after two years of separation whether the spouse agrees or not.
