Now my brother tells me that his income tax refund was seized by the state? Will his ex-wife get that check?

She sure will unless he is married and his current spouse worked and they filed jointly and she files the proper paperwork to stop it. They will even go after his social security when he retires. The ex can also place liens on any and all personal property that he owns. She can then act on this liens and forclose forcing a sale.

Well, that's what happens when you are a deadbeat dad. The money goes to the mother of the child so she can actually feed and clothe him. If the deadbeat jerk paid his child support, everyone would leave him alone.

You might tell him that if he continues not paying, the court will garnish his wage, can seize his bank accounts, put a lien on his home, confiscate what he owns (like cars) and can put him in jail.

He is responsible for supporting his child...period... The courts/government will get it one way of the other.

We, the taxpayers don't have to support HIS kids.....

Yep, he won't get on red cent especially if he is behind on child support. Tell him look on the bright side, his sorry behind could be in jail for non payment of child support which seems to be the case in your description of him. The money will be given to his ex-wife.

hmm...depends if he owes child support,spousal or owes the government, or even unemployment.But they can only seize his state i think not his federal.....not 100 percent sure though

it is money owed and unless he owed to her she cant have it. if he owes her child support then they might be taking it to give it to her. If it is a court order, he must pay it regardless of visitation.

Yes, they can send it to her. As well as garnish his wages. Tell him to grow up and be a man.

It will go to the court, and they will send it to who is supposed to get it.

She will if he's in arrears over child support, which it sounds like he is.

Yes. That is Federal law. She will get it or welfare if she's on that.
