If superman was walking across the road and I didn't see him until I hit him and wrapped my bumper around him, would it be a crime on my part even though there is no way possible that I could have hurt superman (he IS superman . . .)?

Does it make any difference if he had been on a crosswalk?

An accident isn't a crime. If you fled the sceen or didn't have insurance (not sure who has a Superman clause on thier policy but whatever) then it would be a crime Superman or not.

No it wouldn't make a differance if he was on a cross walk, he's Superman for f*ck sake why would he use a cross walk to save the planet from evil-doers?

Superman or not, YOU are entirely responsible for any accidents you cause, and when you hit someone (in or outside a crosswalk) with the front end of your car, who else could be responsible but the driver?

Yes because no matter who or what you hit, you are obliged to at all times drive in a manner to avoid an accident. And ESPECIALLY if he was on a crosswalk.

You have to yield to pedestrians, even if they can fly. Heck, people yield to ducks or geese walking across the road!

Two factors:

You were driving, he was a pedestrian. You are wrong almost every time, UNLESS he was not on the crosswalk.

If he was jaywalking you should not be worried, he was breaking the law, you were just driving along.
