Teachers take things away for the day if they are causing a distraction or danger. Items are normally returned to the student at the end of the day. If the student persists in the same behaviour, the teacher can keep the item until a parent comes to collect it. The school would hope that the parent would agree to support the school in encouraging the pupil to use the item at the appropriate time and not during lessons.

No, sorry it's NOT STEALING and it IS LAWFUL, Sections 90 and 94 of the Education and Inspections Act 2006 (search for it) say so.

sorry kids: if the rule is your phones get confiscated and not given back that's what we can do.....Applies to fags, lighters, anything you have that school says you can't. On the other hand if the school says 1 week or only given back to parents that's true too. The same act has the 24 hour notification rule for detention (no, we don't need permission).

there are a few rules around how this must be done but provided it's a school rule and you break it the consequences are yours and yours alone.

I could do with a new phone.

No , they confiscate them but must give them back.
I used to use my discretion about when to give something back. If the pupil handed it over, no backchat and an apology I would usually give it back either at the end of the lesson or the day depending on what the offending article was. Any backchat like..'you can't do that' or 'you must give it back at the end of the lesson' etc meant it was kept safe for a few
days.
This of course did not apply to such things as cigarettes, alcohol or knives (they were only penknives then thank goodness).
The lesson is simple, if you don't want to risk it being taken from you..don't bring it to school.
READ THE SCHOOL RULES.

No. That would be called "stealing," and they could get sued for it. There may be a few teachers who do this, but one call from the parent will stop that in a hurry. They DO, however, take mobile phones from children and give them back when school is over. Those things are disruptive in classes, and if a student is unable to use them responsibly, then the teacher is well in their rights to remove the problem.

Yes teachers can take mobiles from you in school. We then use it to phone a premium number and leave it connected until the student collects the phone after school closes. A useful learning curve.

PS .. If confiscated twice, mobiles are connected to premium lines and the student collects the phone at the end of term.

It depends on what school. Some schools would give the mobile back to you at the end of the day. Others might keep them untill a parent or gardian collects it.

I doubt it since that would be stealing which is illegal. Schools have enough on their plates nowadays getting sued by pupils without stealing their phones as well. I think they just mean they can take them away in class and give them back later.

I am not sure about that but if they do take it for the day or even a week if a child breaks the rules they must pay the consiquences. It should be returned though.

At the school where I teach, we can confiscate cell phones, ipods, any electronic devices. We turn it in to the office and the kids have to pay $15 to get it back.

Sometimes....depending on the situation. If the student is aware of the rules and takes it out anyway, then yes they could probably take it away for good.
