I am just fed up. I kicked him out, changed the locks, and told him enough is enough. He's continues to use drugs, he won't get a job, he stays away for weeks at a time, i pay all the bills and provide for our children by myself, and has been doing this for 3 years. He's mad at our oldest daughter for finding his drug paraphenelia in her bathroom, now she has lost all respect for him. I refuse to let him back in, and I've told him I want a divorce. He's not on my lease, and has never been on any lease with me. He calls out of the blue and tells me the police says because we're married I can't kick him out. Now let's be real, if I chose not to live with someone anyone(married or not) that is my business, and no one can tell me to live with someone who's not only a danger to himself, but to me and our children. He's out, and he's staying out, the locks are already changed, and his name will never be on this lease.
My question is:" Do I have to let this man back into this apartment?

Go to the courthouse and get a "move out order" issued. You may want a protective order as well. Start proceedings for a "legal separation."

I don't understand how anyone can force you to take him back. He is a danger to you and your children.

Really, go to a judge. Let your apartment complex know what's going on as well. They frown on drug users inhabiting their buildings.

Nope. Legally you aren't bound too. Good for you! Keep him out. You can still have papers filed for divorce. It might depend on the state you live in, but I think you can divorce someone anyway even if they don't want one. And if the kids are young, you can sue for full custody, because his drug proof is enough for the courts. Keep at it and stay at it =)

No. If his name is not on the lease, you do not have to let him in (or anyone else for that matter). The police wouldn't force you to let him in anymore than they would force you to let me in. It's your apartment.
