Without seeing or hearing the evidence, I would say that the problem was most likely an ill-prepared prosecution. We send a Jury to deliberation with instructions that they must find a person guilty beyond a reasonable doubt or acquit. If the prosecutor did not foresee and discredit alternate scenarios, shame on him. Remember that the man's previous conviction could not be a point of consideration for the jury. From what I read, ya, the man probably was guilty, but worse yet, he should not have been walking around free in the first place if he was convicted of raping a child. Yes, I do believe in the death penalty for things like murder and rape.

You Know Chula, we dont really know what really happened, just based on this article....I have been a juror on cases and in one of those ther were accusing a man for raping. And It was obvious that he did not do it and that the kids were all lying..But in the eyes of society, we tend to blame people immidiately whithout really knowing all the details behind the Problem. I am sure that there was something that the jurors saw that we are not seeing right now. Now, the guys is a bad dude, I wont argue that...He is probably a drug addict and who knows what elese, but from that to rape, I dont know about that....

I can't tell for sure whether he was guilty of the crime he was acquitted of. But I know for sure one thing that is VERY wrong with our justice system: " past conviction for raping a 12-year-old girl." There is a BIG problem with any "justice" system that ever releases somebody who had raped a 12-year-old girl. How do we get laws and judges like that? Is there really anybody in the world who believes a rapist of a child should ever be released?

I'm going to say something very unpopular:
This is an example of the justice system working as it is supposed to. The prosecution didn't have enough evidence and so the defendant was aquitted.
Remember, just because someone is charged with a crime doesn't mean they are guilty of it.

The fact that prosecutors failed the system. Remember you have to convince all 12 people to get a verdict so the fact that the prosecution could not get a conviction is their fault.

You read a one page article and you presume that you have a better idea of what happened in that man's house and that courtroom than the jury???

The jury listened to the testimony for six days. We did not.
The jury got to evaluate the credibility of that testimony. We did not.
The jury got to examine the evidence itself. We did not.
The jury was instructed on the law in South Carolina. We were not.
The jury deliberated for two days. We did not.
The jury had to thoughtfully consider its decision and stand up and render a verdict. We have the luxury of popping off on it anonymously on the internet.
