At the Federal level automatic weapons and destructive weapons require a license referred too as a "tax stamp." Long guns and hand guns do not.
Some states require a license or permit for hand guns.

It is not a question legal or illegal as it falls within the second amendment of the US constitution. The amendment guarantees individual ownership. So far neither the pro nor anti gun as tested this at the supreme court level. It is better to let "sleeping dogs lie."
