My coworker was fired due to a hate campaign perpetuated by another employee which is a doctor. Everyone including our manager agrees that the good doctor is a lunatic, the owners of the corporation said to fire my coworker, just to shut the doctor up, knowing that everything she said and wrote was a lie? Does a person have any recourse in this kind of situation?

Believe it or not, it may not be illegal to fire someone for those reasons. It may not qualify as discrimination. An employer has wide latitude within the law to create the atmosphere they want in their workplace. If the psycho is like that to everyone, there may be no recourse for your friend. The best plan is to go to a lawyer sooner rather than later. Spell out the circumstances specifically, meaning be ready to show what lies were told and when. Then the lawyer will tell you if a law was broken.

More correctly - Texas is an "at will" employment state. Simply stated, either party can terminate without stating a reason.

Two things to consider here

First is the reason given for termination. If the employer tells the state that termination is "for cause" it is unlikely your friend would be able to draw unemployment benefits. If on the other hand the reason given is something like "business is off and we could not afford to keep her on the payroll", she would have no problems collecting umemployment benefits.

The second thing to consider is that the burden of proof is in the worker to prove wrongful termination. Is your friend prepared to go that route?

everything comes down to proof and unfortunately, that burden is on your friend.

proof of this hate campaign is needed for any action to be taken seriously. dig up emails, coversations, memos, ANYTHING that can prove that this is why your friend was termned.

once you have proof, then take that to a lawyer and file suit.

she should also be filing for unemployment and getting the state job agency's help too.

Texas is a very “employer friendly” state, perhaps the most employee hostile state. Your friend has zero chance.
