Too bad you got a customer service rep who lacks a sense of humor. You don't need a lawyer, you need your state rep. These are taxes and surcharges that utility companies are allowed to charge. If you don't like them, you need your congressman and representative to go to work for you.
The delivery charge is to get the gas from the tapped wells through the pipelines, to the holding tanks, and down to your house so that when you flick the switch, viola, you've got gas!
$28 sounds reasonable to me.

You can hire a lawyer and fight the delivery charge but the result will be the same. You will pay the charge. The delivery charge is for the cost of sending the gas through the pipes and into your house. It is supposed to offset the cost to the utility for replacing old pipes.

This is your first gas bill, isn't it?
No, you can't fight it, and you don't need a lawyer. Gas companies, electric companies, and phone companies all charge a 'delivery fee' to get you your fuel/energy.
It is part of a contract you signed to have them come around and fill your tank to begin with (and believe me you signed a contract or they would not have showed up). Go back and read it. You'll find that you specified you'd pay for the fuel - regardless of how much you bought - and a flat fee for not having to call them to come top it up every month.

By the time you pay for a lawyer, you mind as well pay the delivery charge. I never heard of a delivery charge for a gas bill.

There is no way to fight these charges. It is another way to up the cost. I know that the delivery charge covers the cost to bring the gas through the system to your home. It covers upkeep and maintenance. I think we are stuck with these clever little terms on our bills.
What kills me are charges from plumbers and the like for travel. What do they think that we can bring our plumbing problems to them ?

Gas doesn't just teleport into your house. It has to go through some form of delivery system - most likely a pipeline.
This charge is legitimate, and you made yourself sound rather foolish when you tried to fight it that way.

did you get the gas, or not, do you live in town or out in the country and have a gas barrel that the gas company needs to come and fill and if you do they do not have to get you to sign any thing when the do deliver

Sure call a lawyer and then you will be paying the gas company and lawyer fees if you can find one to take such a silly case.
