Hello which Indian Law provides seven years imprisonment for having an affair with some other lady then his wife? Will you please first tell me that? By the way who say ladies in our country are not breaking silence due to fear of society? May be you are not watching news on TV, or read newspaper. Every day there is a news about a lady fighting against the act of cruelty, dowry demand, sexual harassment, matrimonial dispute with husband & other in laws etc not only in cities but even in small towns & villages & you say they are not breaking silence due to fear of society. Do you know the legal awareness is more in ladies of modern society? The day the protection of women from domestic violence act, 2005 came into existence the very next day complaints were made under this Act for various domestic violence by the women who were facing it. A husband if want to give divorce to his wife for any break in their matrimonial life & if wife is not agreeable to the divorce ,then the poor husband has to face all these charges of cruelty under section 498A of Indian Penal Code, charges of dowry demand under the dowry prohibition Act & extortion under the IPC, charges of domestic violence & harassment under the Protection of women from domestic violence Act ,etc before his actual divorce petition is taken up, so the poor fellow has to first deal with these first then think of getting divorce, and that too when he will be able to get bail from the court for these offences he has been charged with. You say many women are not breaking silence due to fear of society I'll say many men are not breaking silence due to fear of their woman, after all who wants to spend nights in a dingy room of the jail.

Obviously..Fight for Justice which is the basic right of a citizen.
But then provided you have not committed any injustice!!!
But then if you are a woman and you are having an affair - the idiotic Indian Legal, Judicial and the Law'n Order Machineries of the country would consider you still a victim, the statement publicised by NCW 2 months ago!!
Again does fighting for Justice mean punishing someone? or Is it that according to you Justice and Rights mean Punishing? - Looks like this very attitude of the above mentioned woman has made her husband seek resort in another woman who probably happens to be a much better Lady than this Woman. So probably he has been victimised by this Woman.

Remember that Ahimsa is a tenet of Hinduism ... and that God can take care of things better than the law ... so it is best to put it all in God's hands because God solves all problems better than anything or anyone else ...
So, you do not need to break silence, only to speak with God and tell him all the time what is going on... God is the eternal witness, and does know and see what happens, but if you ask him to help you, he will!

Wow, can a guy really go to jail for that? That's great! I wish the US would make some laws like that. Maybe we wouldn't have so many cheaters then. I think she should tell the truth and put the guy away. Infidelity is the worst kind of abuse. Hopefully he will learn something while in jail.

If that's Indian Law then I suggest she try to work things out with him as best as possible because if he's in jail then how is he going to make income to support the children (unless he or she is wealthy)? It would be harder on both of you without him but I suppose it would depend on what kind of person he is, aside from the obvious and serious mistake he made here.

I am sure she is sacrificing her right and her freedom just for her kids that is what a mother is ( a god) She knows that all she has to concentrate on is her kids. may be she is quiet for her kids future, but according to me she should fight because he is repeating the same

Live in India as an Indian uninfluenced by the west. Own Dharma though false/wrong is much better than others' Dharma though true/right. No apology & forgiving if no mistake, wrong/ offence.
In India, a wife’s sexual intercourse with other/s is no offence, hence no prosecution or punishment to her. Her sex partner too cannot be prosecuted if unaware of her wedlock or had sex with consent or connivance of her husband. Her husband alone can prosecute him and not the police, his wife or anybody else. After divorce also her earning husband has to maintain or pay till she remarries (if unable), even if she is continuously enjoying sex with all other/s. Continuous pre marital sexual intercourses with other/s cannot be a ground to seek divorce under Hindu/Special Marriage Act.
Thus a female’s physical sexual relations with persons/s of her choice (with their consent) is not wrong/offence in any Indian law and she is at liberty to enjoy sex freely and fearlessly. A male’s physical sexual relations with any 16+ female (with her consent) is no wrong/offence in any Indian Law, unless she is in the wedlock of somebody else and is done knowing her wedlock or without her husband’s consent or connivance. Courts have to believe that children born during the wedlock are her husband’s legitimate ones. He is bound to maintain or pay them expenses; till sons are 18+ and daughters are married.
Prostitution (commercial sex trade, offering sex for monetary gain) alone is an offence, yet no Station House Officer, Officer In Charge or Inspector of Police can arrest, enter, search or seize.
Spouses' sexual affairs or having children is no offence/wrong in Hindu or Special Marriage Act. Yet divorce can be obtained on proof. The Islam alone strictly prohibits all unwed sexual affairs with punishments of publicly lashing/death by pelting stones.
There is no concept of divorce in Hinduism. Hindu marriages are performed between their souls (not bodies) in heaven (not upon earth) in presence of 330 million gods and goddesses. Indian Government enacted Hindu Marriage Act in 1955 as legislated by multi religious Members of Parliament and created a chance for divorce to be granted by secular courts. Despite legislations & courts' divorce judgments, their spiritual wedlock remains intact: eternal everlasting & unbreakable even in future rebirths. Despite marriage with others after divorce, wife continues Ardhangini (half body) of her former husband & he continues her Pati Parmeshwar (Lord).
In Islam divorce is the most worst among all permissibles. In unavoidable circumstances only there may be a divorce.
