I have 2 minor son's that receive social security RSDI from their father's death's. Can my son's be adopted by my new husband and still collect their social security or will they no longer receive the money if they are adopted by my husband? The kid's want him to adopt but financially I can not afford to give up that part of my income. Thanks for any help with this question.

My friend adopted his wife's kids, they still got their deceased fathers social security..check with S.S. as that was some time ago..things may have changed.

I don't know for sure about the adoption issue, but I do know that when a woman gets married after a spouse's death, she loses her benefits... so wouldn't it be like the same thing?
It's really nice that your sons and your husband feel that way, but while you are all dependent on that income, it's probably not a good time to do the legal adoption... ask for advice from your "trusted" lawyer! Good luck!

Ideally, you should ask an attorney specializing in family law. Contact the Michigan State Bar association for information.

If he does, they automatically lose their SS benefits. There is no way around that. He can adopt, but be aware of the consequences.

i dont think so. i was adopted by my stepfather, which released my biological father from any financial obligations. being adopted changes nothing anyway. there may come a time you might regret it.

You should probly call social security about that. It is better to be safe than sorry.
