I have DV license plates, my employer wants to konw my disability, I am told by my senior manager, if I have plates I have to be evaluated because I am a risk at work. that it my lead to termination. If i take my plates off no questions will be asked, Need help in Dallas Texas

Oh, this is SOOOOO illegal. Good grief...only in Texas....

Tell your employer:
1) asking questions about the nature of an employee's disability violates the Health Information Portability and Accountability Act (HIPAA), an offense for which you can easily litigate.

2) Terminating an employee for a disability when the employee has demonstrated that s/he is able to perform the essential functions of the job violates so many laws I can't even tell you, under the auspices of the EEOC, the DOL, the DFEH, and a whole bunch of other government agencies. Check www.dol.gov, or www.eeoc.gov, for more info on discrimination against the disabled as well as links to the state agencies.

If they terminate you for this, sue 'em for everything they've got. An employment lawyer will probably take your case on contingency (they get paid by a percentage of what they win for you) because they know they'll get a big award. Those agencies I mentioned above will file a complaint on your behalf for free.

And please accept my apologies on behalf of people in this country who are too ignorant to respect your privacy, and my thanks for all you have done for our country. God bless.

You need to contact the local office of the Equal Employment Opportunity Commission.

Your employer cannot discriminate against you because of a disability. He also cannot legally ask what your disability is.

Your employer is acting in violation of the Americans With Disabilities Act, and if the EEOC determines that this is happening, they can fine your employer and can award you damages.

legally, i dont think they can make u disclose your disability. they cant fire you because you have a disability either. but if they do, just find a lawyer and sue them, then you wont ever have to work again.
