I asked a Target employee if they would sell games (Pokemon Diamond and Pearl) before their release date. She said no. I think I remember hearing about doing so being illegal.

It absolutely is. The store will be fined a lot of money by the company who made the game and the employee will more than likely be fired.

It's not illegal, but it might incur the wrath of the game developers, and if stores sell too many games before the schedule release dates, the developers might ask the distributor to not ship games to that store anymore.

Remember a few years ago when several stores sold Halo 2 before the release date, and MS had a fit? I think MS wrote a letter to the stores asking that they abide by the rules or MS might not send any more games to the stores.

Yes. But I got my copy of Diamond and Pearl today. You'll have better chances getting it from small privately owned stores rather than chain stores.
