You haven't phrased the question correctly. The real contrast is between "law" and "equity." Back in England, the legal courts, as you might guess, applied laws to cases and disputes. When the legal courts reached some decision, then that court was usually bound by its own decision in the future. For instance, if the court decided that it is a crime to, say, intentionally hit someone, then it was bound by that decision in the future. When parties were unhappy with the decisions of the legal courts, they went to the King for clemency--for equity, fairness, etc. That's what the courts of equity were. They heard individual cases and simply applied principles of fairness and equity to come up with some decision. They didn't apply the law, and their decisions were not binding in the future. Each case was viewed individually. (In reaily though, courts of equity also developed their own laws and customs.)
