My wife is currently on maternity leave & will not be returning to work. She has not informed her company (a large corporation in NY) as yet. For 8 weeks she received full pay through short-term disability and her company, and was wondering if she could be penalized for simply quitting upon the end of her leave.

I don't think so, unless she signed a contract with them when she started working there. Most employees are at-will, though, and either party can terminate the employment at any time with no consequence.

Yes. Most companies have a clause that maternity benefits have to be repaid if you don't return to work for a certain period of time. This is to prevent exactly what you are trying to do.

So you have to actually READ your benefits literature.

PLEASE , DON'T EVER BURN YOUR BOATS , AS THEY SAY. I WOULD GIVE THEM A MONTHS NOTICE AND LEAVE ON A HIGH NOTE . GOOD LUCK .
