My partner purchased a settee, on finance, (buy now pay later or pay full amount of settee in12months time and pay no interest.) My partner didn't live with me when we purchased the settee, he took out the credit agreement in his name from his mothers address.He did this as a favour for me, as i couldn't get the finance, we agreed that i would save up to pay for the settee outright at the end of the 12 months. I saved up the money and shortly after my partner moved in with me, however due to him constantly leaving me in financail difficulties i had to keep breaking into the settee money to pay bills etc, soon it was all gone, Now my partner and i have seperated, it is time to pay for the settee and he is refusing to pay the finance, and has told me he will get them to re-possess the settee rather than pay for something he is not using.
Can he do this? Can they take my settee away even though it is not me that has broken the credit agreement?? Help!! I am worried sick, i have 3 kids

Legally it is he who took the settee on lease or buy now pay later etc. and unless he pays, they have every right to take it away. That you dipped into your savings to help him out is between you and him. Now that he is gone from your life, write off the money which you spent as a bad expense.

If you can renegotiate with them and get the agreement extended by paying a part of the money and some interest and get the agreement transfered in your name, it may be worth doing.

Unfortunately for you, yes he can do it. It's in his name so it's his agreement. If you want to keep it, you'll have to try and agree a repayment plan with him where you pay the money to him for him to pay to the company. But then unless its written and legally binding (which is gonna mean paying out for a solicitor) there's nothing to stop him changing his mind and leaving you further out of pocket. Which is a lot of hassle for a sofa!
Personally I'd let it go and get a secondhand one from somewhere until you can afford a new one. Have a look on freecycle + see if you can get one on there, it won't cost you anything then!

the finance agreement is in your partners name, NO you are not responsible for paying for the sofa. if you want to keep the sofa, phone the company up tell them the situation and ask them to give you some options on what you should do, tecinaly the sofa belongs to your partner, have you told him if he wants the sofa he can take it?
if he doesn't want the sofa and tells you that you can have it, he is still legally by law of the contract,, to pay for the sofa.
so don't worry, the sofa is in his name, he has to take the responsible action to inform the company. tell the company your partners address and you wont have any problems

Yes they can take it because it is in his name and technically his property, however if he does this and he doesn't pay his finance he will get a poor credit rating and this will impact any future loans he takes out (because he has defulted on the loan). If you're particularly spiteful this may not be a bad idea because it will teach him a mighty fine lesson!

if he purchased the settee for you to use, and you have it, the DECENT thing would be for you to pay for it.

well if you want it pay for it!!!!!!!! if he has to pay then yes he should have it repossed from you
