they say that "care will be taken to avoid your items within the photos".
Photos are taken at each inspection no matter what.
I don't want to request copies of the photos only to have the agent say no I have no legal right! HELP!

Yes you can ask for copies. You have the right to check if they make good on their promise to "avoid your items".

They may (probably will) charge you for this service and you may want to know in advance what it will cost. Prices can be pretty steep. On the other hand, most do it digitally and may mail you 'your' pictures for free.

Since the Realtor was engaged by your Landlord you do not have the rights to the pictures. However, a polite request may yield results.

If the pictures were taken before the close of escrow, it is your property.
