yes i realize the employer would terminate someone for it, but they wouldn't find out due to medical records being confidential.

the illegal part in my question really refers to, when the patient decides to admit to the doctor or HMO that the patient exxagerated the symptoms in order to get that doctor's note.

Most jobs if you are off for more than 3 days you have to get a doctor's note.

Faking a mental disorder to validate absence from work is falsification under the Penal Law and it is penalized by imprisonment plus fines.

Depends where you are. More than likely it is not illegal (in that the police cannot arrest you for it) but the workplace would have a right to sue for any money they lost or inconvenience they suffered as a result.
