his birth certificate says female but he has a male social security card...and then if it is commen law , does the same rules apply ?

If he has completed the gender reassignment process and is now, for all intents and purposes, considered a man; it is legal. If, however, you were misled into believing that he was always a man, and were induced into marrying him by fraud; the marriage can be annuled. If your state recognizes common law marriage, I believe that the same rules would apply as if it were an official marriage.

In this day and age and if she has done all the surgery, then yes. Whether you knew what she did or not although I would hope she would have told you who she previosly was. I don''t pay attention to common law marriage because I don't believe in it. That is entirely another issue. Social security card numbers don't change just because someone decides to change their sexual presentation.

if his social security card says male, and he goes about legally as a male, then he is considered male in the eyes of the law. (its actually like, Jussssssttt slipping past the rule and getting lucky) because truthfully he is still a she. reguardless of what papers say....so technically it wouldnt be considered a real marriage, but you MIGHT be able to get away with it.

This article talks about a couple who were already married and the man got a sex change. Apparently it depends on state laws. Common law is rare but it still occurs. (in certain states) I'm still looking for more info. that would better answer this question.

States go by birth cert...sorry. You could go to one of the states that allow same sex marriage. Common law is gone in MOST states. If you live in a state that has common law and same sex marriage then yes...it does. My personal opinion only of course.

It's a woman no matter what she does. Dressing as a man and putting on a fake member does nothing to change that. That's not a valid marriage, unless you're a guy.

It would be better to go to a local marriage agency for the answer to this; if the gender change is legal in your area then probably the marriage would be legal too.

In the US, It actually depends on state laws. Some accept it while other don't...Usually a court must make the decision.

Yes...Once a person goes through a sex change operation,Their gender is also legally changed as well.
Don't know about you being able to have a family though.
