this means patents, literature(text), art, music, software, code, et cetera. By no longer private, I mean people sell them, but they are no longer limited by having to buy them or following terms of use.

I can't believe that progress will stop immediately after you lessen the amount of money a person can make off of an idea. Did Linus Torvals make a fortune off of Linux(which is open domain)? There are few professional poets, but poetry is still abundant. What does it hurt to open up the availability of this property? There are still ways to make money off of your ideas. For instance, I'm sure there are still many people who buy CDs even when they can download the music files. Not everybody has an MP3 compatible CD player in their car or one that is CDRW compatible so CDs continue to sell. When you buy a CD you also get artwork, lyrics and extras you might not be able to download. There's more to it than profit, but profit isn't necessarily gone for artists and programmers.

Using your example of a music CD being packaged and sold.......

What if YOU spent a year writing and recording a dozen or more songs, then you shared them with your friends and made some CD's to sell, but they weren't too fancy.
THEN- one of your friends whom you gave a copy to packages it nicely and presents it to a record company, with HIS name on it. A few months later, three songs on the album have hit #1, and the album has gone triple platinum. Your friend goes on stage lip-syncing to your music every night to thousands of screaming fans. Your 'friend' has gained fame and fortune and a whole new career, but YOUR name was never on it and you're still a nobody.

Does THAT seem fair?!?

The proper way to go about it is to COPYRIGHT the music, license your friend to package it and promote it with YOUR name on it as the artist. Your friend (and the record company)still makes money, but YOU'RE not left out in the cold.
Isn't that nicer?!?

That's what it's all about..........

As for Dr. Torvals, he is doing quite well with a Linux company, which along with the others, countersue each other for sneaking off with supposed private information. The day of the totally selfless individual in a market economy is over and has been for years.

then anyone could take anyones ideas and market them for profit. the idea behind intellectual property law is that a person can copyright their ideas/products so that noone else can market them. if i create something...then i should profit from it...and if you want to utilize it for some reason, then you should pay me for it! my dad was an intellectual property lawyer for over 40 years!

True, poets are still writing, but those that do not copyright their works are poor. But, then again, it was never a high paying field so maybe they don't care.

No matter how you try to justify it, theft is still theft. That applies to intellectual property rights as well as real property rights.
