I hate to say this but the person responsible for the financial damages is the person who caused it- the vandals. Sure you could bring up a case against the property owner (with the idea that he/she should have kept a safer lot), but it's a stretch at best.

This is a "mutual bailment" where both the baylor (you) and bailee (the mechanic's lot) benefit assuming this was a situation where you were hiring the mechanics to fix your car for a fee. Therefore, the owners are held to a reasonable care standard. In order for you to recover you would have to prove that the lot owners were negligent in some way. For example, if they failed to lock the gates that night or failed to do background checks and hired thieves then they would be negligent and you could recover.
Unless you lost a lot, it is probably not worth the expense of litigation. But maybe if you get a lawyer and let the lot owners know that you know what your rights are then maybe they'll settle with you easily! Good luck!

If you do not carry comp/collision coverage on your insurance policy, then you will have to pay for the damages on your own. Check the paperwork that the shop gave you when you dropped your car off. There is most likely a clause stating that they are not responsible for damage to your car by vandals. It would be the same as your car being vandalized in front of your own home.

I'd question why YOUR insurance won't cover it. But you should certainly be able to hold the property owner responsible, especially if you left your vehicle in their care, which is what it sounds like. Try filing a complaint in small claims court. And make your insurance company put their denial, with explanation, in writing.

This sucks for you I'm sorry but parking lots are private property. You will have to see if the company who owns it has insurance that will cover you. My car was hit in a parking lot and when I went to make a police report they said "there's nothign we can do it's private property".

Me and my three friends (All in our late 20's) have formed a team to help out our neighborhood. I wear a Jar Jar Binks costume and am the leader. Then there is the guy who wears the Grimace costume, he is the strong man. Then there is the guy who is a convicted sex offender, he wears a trenchcoat like the matrix. And lastly, their is "The Professional", he wears a cardboard Burgerking crown and a fake muscle suit. We walk around town and knock on random doors. When the person answers, I dance and do a Jar Jar quote, then make a loud screech with an air horn. While the person is reeling from the sound, the sex offender confesses that he is a sex offender (as required by his parole). Then the grimace throws some leaves and dirt into the persons house. And lastly, Muscle King plays 'me so horny' on his boombox and we dance. We have done this to hundreds of houses. Are we some kind of kings? I don't know how?

Do they have a "not responsible for theft,damage etc.. on an estimate/work order signed by you? Was/is there any kind of sign in or on the premises? If not, you might get something, but you better have video/witnesses that will verify it didn't exist before you pursue, and before the date of occurrence.
