The argument of the detractors of the second amendment is that the general public has no need for automatic, and high powered weapons like those of the military. The point of the second amendment was so citizens would be as well armed as the government, so they could never be oppressed by it. They state that when the second amendment was written, they only had muskets. But at the time, the muskets were all the government we overthrew had as well. So the intent is for each citizen to be as well armed as the government and as they feel the need to.

"A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed. "

This is one of my favorite things to recite. I love it. When the founders of this great country came together, the basic idea for America was a fair government based upon the states. The states were initially given more or less equal power to that of the federal government. Over time this has changed in some aspects, but in the case of the Second Amendment, it has not. Each state has the choice as to what guns are legal, can you carry, etc. The Federal government does not have a say in the matter. However, right now people like Feinstein & Boxer (I am not sure of their names) are attempting to institute a series of gun bans on the federal level. The NRA and other organizations are fighting this as we speak and it will hopefully not pass, but who knows. When the Federal government gets involved there will be a real problem...look at Ruby Ridge-imagine that scenario times every lawful gun owner in America...I do not see that happening.

The 2nd Amendment does not apply to the states. It specifically prevents the federal government from passing a law infringing on the right of citizens to bear arms.

The 2nd amendment was the founding fathers method of making sure that the government would never again be the primary oppressor of the people, giving the people the right to bear arms and take them up against the government the people in it tried to usurp the power granted to the citizenry by the constitution.

Whether or not it was intended to allow the citizenry to bear arms for the purpose of fighting one another is up for debate.
