my friend was driving to a job site today, when out of nowhere he was slammed into by a small car, the small car sped of before he could get the plates. the work truck is in bad condition and my friend was hurt. minutes after he contacted the police he called the office. unbeknownst to him after he called our boss the boss clocked him out, even though the accident wasnt his fault and he was two hours away . my friend lost four hours of pay without knowing. what is the law in this sitiuation? thanks for the help.

Where are you located?

The fact that his boss clocked him out will not change his eligibility for Workers' Comp. He should ask his boss for a claim form or get one from the nearest Workers' Comp board in your state.

If his boss claims this wasn't Workers' Comp then he has a right to sue the company. In that case I'd find a lawyer who would send a lawyer's letter for $200. (maybe less). Usually that makes bosses very cooperative.

Is his "time card" the same everyday? This way he might can prove his "clock-in time." My ex was in a serious accident that required him to stay in the hospital for a week, and he was out of work for several weeks. The company he worked for tried to say that he was off the clock at the time. No go...we hired a team of lawyers and fought it in court. He was awarded $96,000.00 for the accident. My advice to you, get a lawyer right away!!! Many lawyers will come to you in the hospital if you're too hurt to go to their office. Fight it in court if you're right. Many times they'll want to settle out of court so that their insurance doesn't go up. Any complications needs to be verified by a doctor. As a result of my ex's accident, he had a heart attack. Keep everything in writing!

What his boss did is very illegal. Contact your local labor commission, or any good lawyer.

His Boss commited fraud. His Boss can go to jail
