I'd like to take everything gingling in his pants pocket if you know what I mean. He has a good paying job but has not given us a dime since he left two years ago. I have been taking care of the boys and all the bills alone maxing out four credit cards.

I am suprised you let it go that far, bring the paperwork to the family assistance in your town. He will get hit so hard and won't know what happened. These people are great at collecting money for you, but the down side is it goes through them before you get yours. They will attach and garnish his wages.

If the court ordered child suport and he is not paying the child support, he is in contempt of court.

Talk to your area's Family Services and find out what can be done. In some states, wages can be garnished to cover back support.

It is hard for me to say what all will happen, as I do not know where you live, but there are ways you can go through the courts to get your back support. Utilize them.

In Ohio, the local sherriff's department posts the most wanted deadbeat prents on their websites (at least Franklin County does). Refusal to pay support is a crime here in Ohio, and jail time can be spent for it. Check out what your sherriff does.

Are you registered with Child Support Services. That's a way to start. Keep them posted with his work and address. Second, take him to court, on contempt he maybe required to pay your legal bill also. After he gets behind more then $2000.00 then the state child support service will take his drivers license away, and put him in jail. Some states are even harder and they do prison time. This will be a start.
Get this taken care of right away.

You can't touch his 401(k), but, you can garnish his salary. You need to petition your local family court, he is required by law to pay child support. If he has been ordered to pay child support and he doesn't you can have him arrested. Contact the court and pursue this matter with them. I would call the court clerk and get some advice from them. You cannot go after the 401k but if he is working, he is getting a paycheck. You can have that garnished so that your money is taken out and sent to you before he even gets his paycheck. And if he gets anything back on his tax return you can have that garnished to pay back child support as well.

Nope, you can't get his 401(k) for child support. Go back to court and get a wage assignment for the child support.

I think you can pretty much go for anything in this case, I'd talk to your attorney and let he/she know the situation and go after him for child support. If you have your orignal divorce papers or decree, it should state in their what financially he's responsible for, and if he hasn't done anything, he can be held in contempt of court, or the court can relinquish his wages for it.....

You cannot go after his 401K but you can take his tax returns if he has any. The only thing going to court might do is attach a lien against his 401K but you wont get any money until the fund is cashed out.

Nope but you can have his wages garnished and lein his taxes.

This is a question for your attorney, but I honestly think so. Doesn't matter about his job, he owes his child and you!!!!!!!
