I have been searching for my son for the last seven years, after finding him I settled for return of visitation on a regular basis which kinda lets my ex off for denying me visitation for so long, I was wondering If I had a civil case as well

I wish I had a better answers for you, but the answer for your situation is no. Once you've reached a settlement, you can't go back for a "do-over" because you weren't aware of how things actually work. In order to receive any type of compensation, you would have to have initially had a joint custody agreement with visitiation that she broke. You would have also had to have pressed kidnapping charges and then she'd actually have to be charged before you could seek monetary damages from her in civil court.

However, there is an upside to this. If simple "visitation" isn't working for you, you do have grounds to seek primary placement. Just make sure that decision would be in the best interest of your son. I understand being angry with the ex.....I just think he's suffered enough without having to go through anymore.

If you can find an attorney to take the case you can sue her but that doesn't mean you'll win. How would it affect your son to have his parents in court fighting?

What she did was wrong and nothing will give you back those years you lost. It's up to you to decide what you want to do with the years you have left.

I don;t know about having a civil case but if you had visitation and he refused to allow you to see the child or took the child away, you can have him in contempt for both interfering with your parental rights and also for not following whatever visitation was ordered.

I would contact an attorney but I would think that for those seven years she was in contempt of the court by disregarding the court order. It's worth a shot...maybe they will lock her up for a while and you can have your son to yourself so she can see what you went through.

If I were you I would seek legal advice but it seems like the good fathers like yourself that pay child support and want to be with their kids always get screwed around and you probably will have no recourse but I would look into it anyway.

You settled. You can't sue now. You should've pressed criminal charges...then you could've sued in civil court.
