When I married my husband in 1996, he eventually told me he was married in Mexico at the same time. Does that mean our marriage here in the US is no good? I think it probably is some kind of fraud.

A few years ago, he claimed that they completed a divorce, but it was still during our marriage, and I have not seen any documents.

Your marriage with this man is absolutely illegal & void as he has committed bigamy which not only is an offence but ever renders his second marriage with as invalid. You have no legal rights of inheritance, neither maintenance etc nor you have legal right to seek any other matrimonial relief’s a legal wife can get. Even if he divorce his first wife now he still has to marry you again to make the process of getting legally married as his present marriage with you is already void & of no legal consequence.

I hate to be the bearer of bad news but your marriage license is invalid. The same thing happened to me...unfortunately. When my husband and I got married, I didn't realize he hadn't been fully divorced from his first wife who also lived here but in a different state. Wasn't finalized. So I had come to find out that we weren't legally married. His wife, if deviate, could charge your husband with bigamy. Not a very good thing to be hanging over ones head. So to make sure, I would call the court house where this marriage took place or you might be able to look it up on the net. Regardless, you need to find out or your marriage may not be valid to where you are going to end up with some problems not only legal problems but other problems as well. Good luck! If he was married already when he married you, your marriage is probably not valid even if he got a divorce from the other after he married you. Check with a lawyer for sure. There are probably some free places you can find if you don't have the money. Is he an American citizen or do you think he was using you for papers???? If the latter, report him and have him deported!!!! You are in a mess with a liar. You better get rid of him quick. Good luck!

In most states the only real reason for a void marriage is if a party was already married. The US recongnizes Mexican marriage licenses. So you're not really married. You're license is valid because the state you live in likely doesn't know about the other wife, if they found out it wouldn't be valid.
You're more than likely going to have to divorce him unless you can come up with proof. You want half of his assets anyway right???
He may come up with documents if you start to take him to the cleaners then sue him for fraud.

This is a very big deal and you need a lawyer to find out what your rights are. That is the legal issue. The emotional issue is that this man may have deceived you in the worst possible way. As a result, you are going to potentially have emotional backlash as well as legal/financial considerations to figure out.
I suggest not just a lawyer but a very smart friend and/or a therapist. I don't know about u, and u don't say, but I would personally feel emotionally devastated if this guy has been deceiving you about marital status all along.

Best thing to do is to call legal aid and just ask them the question. I was in a similar situation and they told me that if my first "marriage" was in a country that was a signatory on the treaty of ??? (I can't believe it but I don't remember which one), then it's valid. If not, the license is not valid--mine was not. Thank God!

I would seek proof of a marriage and divorce that allegedly took place in Mexico .
Consult an attorney in this matter.
If he was married already in mexico but not divorced yet then your marriage is not official ( legal).

He committed Bigamy which is illegal in the United States. Your marriage is technically not valid. I feel for you. Good luck in whatever decision you make to resolve this.

The short answer is virtually. Under United States law, he will be considered a bigamist, and can certainly be charged and convicted.
Your marital rights, to homes property in children are intact, but you need to seek legal advice in the jurisdiction where you reside.
