The music itself is copyrighted. Reproduction of the copyrighted material is a violation of the copyright, unless licensed (which it usually is, through a publishing society such as ASCAP or BMI).

no guess or opinion. Performance of music is authorized by the composer (or publisher) through the organization where he is a member, generally ASCAP, BMI or SESAC. The venue (radio station, music hall, theater, etc) where the performance is hosted is responsible for paying the royalty which is commonly based on audience size. The performance organizations all have web sites which give information on fees.
