In NY you kill with a gun during the commission of a crime it's 15-20 minimium or life is possible. If there was no other crime at the time it could be "man 2" and you might do 3-5. A 17 year old is likely to be tried as an adult if negligence or other criminal activity was invloved such as attempted robbery at the time of the shooting.

If the shooter gets caught, and the shooting was in NYC plea it out. If you shot someone, you are not innocent in NYC, you'll do time period. Upstate juries are more leinient toward justifiable defenses. Again, as long as there were no other felonies surrounding the shooting. If so fughedaboutit you're screwed.

depends on circumstances but certianly jail in the meantime before trial!
