My girlfriend's ex-husband just past away. They have a 7-year old son together. The ex-husband's name is on the 7-year old's birth certificate. They god married two years after he was born and divorced three years later. My girlfriend and I are not married, but we have a 14-month old daughter together. My girlfriend lives in this country illegally. I know that her son is eligible for social security benefits. Is my girlfriend also eligible for surviving spousal benefits since she is the mother of her ex-husband's minor child?

No Only the son is eligible until he's 18,not the wife or in this case the ex, unless the wife is 65 years old / not divorced

Not sure but I *think* it's just the kid who qualifies. I think you have to be currently married to get the spousal benefits. Minority or not.

She's not eligible because she wasn't a surviving spouse they were divorced when he passed.
