If it's his fence, then it's on his property and therefore, no you can't.

I'm thinking you better check the law in your area first....Open the link below. You have too many answers that say yes but you also know about specific laws in you city , county or state. Just to be safe I would check it out.

From the 'Lectric Law Library's stacks
Fences:
.........Laws, Problems & Solutions.......
http://www.lectlaw.com/files/lat05.htm
Also, what may have started out perfectly legal may later exceed the
law. For example, a nice little hedge fence may grow into a 15-foot
natural wall. If both neighbors like it, nothing is ever said, and there
it stands.

........Before you complain about a neighbor's recently erected monstrosity (or
one that is going up before your eyes), go to city hall or the public
library and read your local fence ordinances carefully to see whether
the neighbor is breaking the law. It's a wise idea to do the same thing
if you are unsure of whether your own plans for a new fence comply with
local law. Laws that affect fences may be found in the zoning
ordinances, building codes and also under miscellaneous rules.

Do you really want to paint the fence? If you do it once you might have to keep on doing it. You would certainly be responsible for any damage that might occur.

If it is an eyesore in some way, I'd be more interested in getting my neighbour to do the painting and sit out drinking a nice Pimms or something whilst I watched him (guess it's a him) working up a sweat.

Been there, done that. If it's on your side, and you can actually walk around the fence without stepping on their property (think 3-5' on your side), then yes, hire attorneys, call authorities, etc. Otherwise, consider their paint on their side a weatherproof barrier that will prolong the life of your fence and maybe then thank them for their labor. Who knows, it just might work. Or the morons will be out scraping their paint off.

No. You need to find out which part of the fence you are responsible for. You are only responsible for the far back of your fence and one side, so ask for your neighbour's permission first just in case.

if the fence is right on the property line i would say yes but if it is not and on just his side you need to ask permission first, but i can't see why he would mind since he isn't the one seeing it

In the UK you can, but make sure your paint, or varnish doesn't seep through to his side. Often it gets down to a matter of good neighbour relationships!

Surely it's common courtesy to ask if it's ok to paint it. He would probably be grateful if you were prepared to do the hard work - but dont just go ahead and do it. Speak with your neighbour first.

I wouldn't. If it's on his property, you're trespassing and could be charged with malicious destruction..

Ask.. it's better than having to replace HIS fence.

You could - but why not just say that you are thinking of doing it? He might be delighted that you are protecting the panels of your own free will and at no cost to him!

Just check the colour on his side of the fence as he will be annoyed if you dribble green all over his red so to speak and you could start a war!
