i was working for an employer and payed at point26. due to funding i had to get another job with them. this was verbally offered at point 20 but when the contract was sent to sign, the job was offered at point 26. my employers now say they have made a mistake and the position is to be payed at point 20 thus reducing the amount of pay i will receive by £4000 approx. is my signed contract legally binding even though i verbally accepted a lower payscale???

Clearly, they did make a mistake, and you are honor-bound to accept an amendment to the contract to change the terms to the ones you actually agreed to. Remember, if you try to hold them to an error instead of honoring your agreement, they always have the option of firing you instead of paying you 4000 pounds more than they budgeted for your position.

Is it a signed contract or simply just an application? If it is an official contract (signed by your employer), then they are obligated to pay you for the amount specified for the time specified. If it is not an actual contract, they can change the terms at their leisure.

By the way, even if you have a contract, forcing them to pay more based on an error will not generate good relations with your employer. They may choose to terminate you at the first chance they get. I find it is always best to do as the employer wants, as long as you need the job.

Okay, let's get real here.

When you signed the contract, you either didn't notice the mistake, or you noticed it and kept your mouth shut. Either way, you showed up to sign the contract expecting 20.

If you push this, you might well win the 26, but what's that going to do to your chances of keeping this job, being continued on another contract, or getting a decent reference after they find some reason to fire you for cause?

You know you agreed to 20 not 26. It's really dishonest to try to use their mistake to get more, and probably unwise to even try.
