This morning I was eating a granola bar and choked on a peice of a blue plastic bag that was in the granola bar. It was a pretty good sized peice. I was alone where I work and by some miracle I coughed it back out now my throat hurts. Should I talk to a lawyer?

No. The appropriate thing to do would be to file a complaint with the company. If they are pro-active, they may give you a coupon for a free box of their product to use.

As you were alone when it happened, you are not going to be able to prove it happened anyway.

If you wanted to even consider suing, you would need to get to a Dr.'s office as soon as possible to even confirm there were any physical damages...if none shown, the you are likely out of luck.

No lawyer will touch the case unless you can show damages, not just inconvenience.

First you were alone, so no one will probably believe you. Second, you will probably just be wasting your money in court fees. I'm sorry that you choked on the bag, but the matter is that the big food companies usually win and keep matters like this quiet and out of the media because they have the money to where they can, so it really isn't worth the pain and aggravation. Just be sure to keep an eye out next time before you take a bite.

You can't sue for choking, that is not a cause of action. A cause of action is a legal claim to recover a remedy. You can't recover a remedy if you were not hurt in any way. Unless this injury that you say you have (your throat hurting) can be properly diagnosed and a procedure is required to heal it, you dont have a cause of action. Even then, you probably won't find a lawyer who would want to take this case.

I say hold on to the wrapper and the plastic and head to the emergency room and get your throat checked and documented.

Then contact Nature Valley and let them know what happened. It could be in a whole batch and they need to recall it before someone else gets hurt or even chokes to death on it.

I don't think you should Sue them but hell if they want to compensate you for it then take it =)

that depends. remember that if you get into this lawsuit its going to take a LONG time and you don't know what the turn out might be, but you WILL have to pay this lawyer for his time. so only do it if you're willing to put in a lot of time and money. I just call or email thier customer service and complain about it. who knows they might give you a years supply of granola!(but only if you really milk it)

Nothing will come of it if you sue. What you need to do is email or call them and let them know exactly what happened. They'll probably ask you to send the thing you found.
