You can tell them that if they sue you you will just enter a counterclaim against them in the same suit for them being wrong so that you may end up as the victor in the case winning money from them. =0) Reminding someone that they can be sued with a defendant's counterclaim even though they are doing the suing as the original plaintiff helps to deter any legal action from them most of the time.

Going to Court is always a risk, even if you know in your heart you are right...sometimes the tricky thing is proving it.
A better solution is to try to work things out with the other party IN WRITING and keeping a copy for yourself. If you cannot work things out, at least it shows that you tried to deal with the party reasonably and rationally prior to getting the Court involved which the Judge will weigh in when determining his decision.

maximum people who say "my lawyer" make it sound like they have an lawyer on retainer. If he employed an lawyer - he paid far extra for the 1st consultation than he gets back. I doubt this might pass any added - particularly if the dispute grew to become into settled on your want by using eBay. even nevertheless, i might question your judgement in no longer giving the guaranty you furnish. in case you furnish a guaranty you may desire to no longer be putting circumstances on it. And in case you forgot to contain a factor - did you deliver it later? And if he certainly did deliver back the board - did you replace it such as you reported? Or have been you retaining it ransom for the comments component. you will no longer be able to make bargains like that. you may desire to have sent the alternative such as you reported you may. comments or no longer. As for the court docket - if it gets that a good distance - they might make you pay off any money. So in case you do no longer pass - the judgement may well be to pay off the what --- $a hundred and fifty.00? does not be properly worth a visit to me for that quantity of money. I doubt that he can sue for a complete 'form new" alternative. properly, he can yet I doubt that could pass in his want. Small claims court docket decide for alternative fee of the unique component. no longer a sparkling component. So he might desire to win a alternative. which you may desire to have taken the intense highway - and altered interior the 1st place.

Personally, I'd try to avoid them if all possible.
If someone actually files with small claims court, you have to show up or they win by default. It's a pain in the **** too.
I'm not suggesting you roll over and kiss their butt, but see if there's another solution before it goes to court.

it depends
what EXACTLY is their gripe or issue
if they make a good point, maybe try to settle it, give em some money or whatever
if they are lying or have no case, go to court then
try to convince everyone to let it go
people's court is mostly , people sueing about $50 issues I think

If you are right then let them sue you. The only thing it is going to cost you is a little bit of your time.
