my lawyer has met with me once, spoken with me twice on the phone (after several voicemail messages requesting him to return my call), I havent received anything in the mail or e-mail notifying me of any work being done on my case, and I still havent been able to pick up my personal property because I am waiting for him to mail the request to my ex's lawyer. It has been 2 months and I still have another month before my next court date. Any suggestions are appreciated and none will be ignored. Thank you

Well, it definitely sounds like you have an unresponsive lawyer. The truth may be that there is not much to be done on the case at the moment but I would think he could be in negotiations with opposing party/attorney regarding your personal property at the very least. If nothing needed to be done and he did nothing - no harm yet. If something needed to be done and he has neglected it - he has committed malpractice. The only thing to do is to go and hire a new attorney. Have that attorney notify your previous attorney that he is now on the case (they will have to submit a paper to the court so that the court will send notices to the correct office). The new attorney should request a copy of your file and a return of any of your retainer that has not yet been spent.

I wouldn't dismiss him right away because he may be working for you, but it may be difficult. If this is not the case, then i would talk to another lawyer. If you think the new one will be better, then he will probably know how to go about taking over your case. But talk to another before changing.
Talk to a few if you like and see what the consensus is, then decide.

If you are really unhappy with your lawyer hire another one and then tell the current one you have decided to get a new one. Make sure you have the new one in place before telling him/her that you have changed.
It could be that he has not been able to make arrangements with the other lawyer or your husband and that is why you have not heard from him.

All you have to do is put in writing that you don't want him representing you anymore.
You will have to tell your new lawyer why you fired your old one or you could have trouble getting all your paperwork back of your old one.

you can have him dismissed on the grounds of legal ethics which he hs broken by law. this is fact. in my opion?
