It has less to do with the flag itself as it does the height of the pole. In the town I live in McDonald's isn't allowed a drive thru, and no signage can be more that 8 feet tall. That goes for all flagpoles too.
People fly more than just the American flag on their poles. i see college and other sports team flags and personally, I find unsightly.

It used to be that communities either developed or adopted codes for the safety of their residents. Today more and more communities are doing it for beautification reasons. Which usually means that someone is gaining power to get things to their satisfaction. Power is the utilmate corrupter. If I were you I would check into the reason behind the code (It really should be fairly obvious) and let them know how you feel. You might change your mind or you might still take action. Yes, same in my neighborhood, but we installed one any way, and fly a very large flag. Let the chips fall where they may.

Be thankful that you don't live in a place with a homeowners association with CC&Rs. I've heard of some pretty nasty flag litigation in some of those places.

Dharma, I see what you mean, but in my town we had the same debate. One guy put up a huge flag and his neighbour couldn't sleep because of the noise of it flapping. Two sides to every story.
