In most states, the driver would get a moving violation ticket for an unbelted passenger.
In some, the passenger would also be cited for failure to wear a seat belt, if they are an adult. Unless I misunderstand the situation ... the ticket to the passenger would be a violation, but would not result in points on the passenger's license (if they have one).
Bottom line ... the driver of a motor vehicle is responsible for everything in the vehicle, including the actions of the passengers (or, in this case, a failure to act). The passengers might be held liable, separately, for their actions.

The driver does trust me. I recevied a speeding ticket in Janurary and when the officer came up to the car my passenger was sleeping in the back of the SUV laying across the seat due to a long road trip across country. I was given a ticket for the passenger not having his seatbelt on.

Here's a true story that happened in Texas. My roommate was riding in the passenger seat and his girlfriend was driving. They got pulled over and my roommate says, "ha ha, you're gettin' a ticket." Then the cop came up and knocked on his window, then gave my roommate the ticket for not wearing his seatbelt.

It is the driver's responsibility to insure that all his/her passengers have their belts fastened. If they are not and the driver gets pulled over by the police, the driver will be cited for not having his passengers belted.
