If their gun is stolen and used in a crime?

If my child has a friend over, and they find my keys and take my care and get in an accident...you BET I would be sued!

You can sue anyone for anything, provided you find a lawyer desperate or crazy enough to do it.

Doesn't mean you'll win.

EDIT: For all the smart alecky "what if someone stole your car" analogies, it's not really the same. If you took reasonable precautions to guard against theft, then you could not be held liable for what happens to your car. If you leave the door open with the engine idling and the keys in the ignition outside of a prison, you're going to have a problem if someone escapes and kills someone with your car.

If a gun is secured lawfully and someone breaks in and steals it, you are not liable. If you leave a loaded gun on the sidewalk and someone uses it in a crime, you probably are.

Having your property stolen does not make you negligent. Nor are you responsible for the bad acts of another adult as a result of a criminal act committed against you. You could probably be sued if someone chose to follow that course, but proving negligence in such a case would be very difficult. Unfortunately just having to defend yourself against such a frivolous suit would be financially damaging win or lose.

You can, but you would have to prove negligence or extreme negligence (depending on which state) in order to have any chance of winning. Then fault would be apportioned between the criminal and the gun owner, so you wouldn't get much.
