About a month ago I was sharing a house with this lady. She moved a bunch of stuff into the garage that she didnt want. I was moving out and into a new house with a friend, and we decided to grab some of the stuff she DIDNT WANT since she was getting rid of it anyways. I guess she noticed, so i just came clean and took all the blame bc my friend (x friend now) told me she had a warrant out and would go to jail if she said she had anything to do with it. SO i got a ticket for stealing and I have court may 3rd. Im only 18. I understand what I did was wrong but the lady got all her stuff back and i apologized...woo woo woo. I dont know if its the same everywhere, but when people get charged the court puts it in the paper for EVERYONE to see. My parents and family are going to end up seeing it, so I guess Im going to tell them soon. BUT- someone told me that if the lady who filed the police report doesnt show up to my court date that the charges will be dropped. This doesnt sound right to

I DID offer to pay her, but that was after the fact. i dont have money to get a lawyer. WHAT DO I DO??? im mainly concerned about my family finding out

Its just a court date. So i can plea guilty or not guilty and get my fines and fees or whatever.

I just calld the cercuit clerk, and they said if i want to plea not guilty so say so at my court date then theyll ask if i want trial by jury or bench trial or something...forgot what the second choice was. Do u think itd b a good idea to plea not guilty then explain myself? if so should i do trial by jury or the other one, and WHY do u think thats the best choice? THANKS!

You need to see a local attorney rather than relying on the advice received in this forum. Laws vary from state and most of the people giving answers here aren't even attorneys.
In most jurisdictions, the file is public record once you have been charged with the crime. Any member of the public can come review the file.
The victim can request that the charges be dropped and the prosecutor or judge can dismiss the case if the victim will not cooperate with the prosecution. However, those decisions and dismissals are not automatic. A dismissal may or may not occur...the court might also grant a continuance to get the witness another chance to show up.

First of all, you need to speak with an attorney. It depends what type of case you were charged with. If it is a misdemeanor, you could get up to one year in jail. If this is your first time, that is highly unlikely. Your first appearnace in court you will need to plead guilty or not guilty. The person who made the charges against you does not have to appear for the first appearance. If you plead not guilty then they will set a trial for you. If the person who made the charges against you does not show up for trial, the charges COULD be dropped, but it depends on whether there is any other evidence the prosecutor would have.
By the way, if the lady didn't want the stuff anyway, why didn't you just ASK her if you could have have the stuff or offer to buy it from her???????

You will probably just get a slap on the wrist since the lady got her stuff back. Just tell the judge that you know what you did was wrong, that you assumed she was getting rid of the stuff and that you should have asked first and not assumed... Make sure you are remorseful for what you did. Less said is better so don't go in to long drawn out detail....

Its possible. it all depends on 2 things...the stragegy of the prosecutor and the desire to prosecute you.
You took items that the woman wanted tog et rid of anyway and just decided she didn't like anyone taking it until she was ready to part with them...generally prosecutors will not touch this one or not spend much time in prep for it...they have bigger fish to fry.
And in the charge it might be neccesary for her to testify or it might be enough for the arresting officers to testify as to what they were told and investigated....it all depends...

You don't say what your court appearance is for. If it is only for arraignment (reading the charges, pleading & setting a trial date), ask for a Public Defender.

Contact the DA who is prosecuting you and try to get a deal.
Maybe they can avoid any charges then.

because it stands with somebody like that i might propose against dropping it. yet once you so want, once you pass to court docket you purely propose you're retreating your complaint against the defendant.

you wont go to jail, what you need to do is go to court and fight it...show that the woman didnt want the stuff, and you brought the stuff back...stuff like that...that isnt right if she pressed charges..you should build up your case and fight it.
